Trump Administration Drops Challenge to Court Ruling on Ethanol and SREs

Farm groups and ethanol producers got a big win as the Trump Administration decide not to seek a re-hearing of a recent ruling by the U.S. Court of Appeals for the Tenth Circuit that struck down certain small refinery exemptions (SREs) under the Renewable Fuel Standard, according to a release from the National Corn Growers Assn.

Dealers Alerted to Consequences of Illegal Modifications to Ag Equipment Systems

Illegal tampering by customers, such as engine “chipping” or tuning, has legal and financial repercussions for dealers.

A third of surveyed dealers say they have had customer-modified equipment come into their shop, according to a recent survey conducted by the Equipment Dealers Assn. What’s more, some of those dealers reported that up to half of the equipment in their shop had been modified or altered from manufacturer settings. Often, these modifications have environmental, safety and liability implications for customers and dealers.

According to a report from Reuters, a U.S. appeals court has ruled that the Environmental Protection Agency (EPA) must reconsider three of the biofuel waivers it recently granted to small oil refineries, arguing the agency’s justification for approving the exemptions was flawed.

The EPA released a proposal last Friday that would increase the required production of biofuels by only 0.6%, from 19.9 billion gallons in 2019 to 20 billion gallons in 2020. This includes 15 billion gallons of ethanol, as well as 5 billion gallons of advanced biofuels, including cellulosic ethanol and biomass-based diesel.
